Reservations, Cancellations and Complaints

General
You can make your reservations through our website. Fontana’s offers are without obligations and subject to availability and capacity. If Fontana invokes this condition within a reasonable period, no reservation agreement will be concluded. If you book online, you don't have to pay bookingscosts. If you pay by mail or by phone, you pay € 2,50 bookingscosts for a dayprogramm and € 7,50 for a hotelstay.

Cancellations
When you make a reservation through our website, you do not have the right to withdraw from this contract by means of the right of withdrawal. The statutory exceptions about renting accommodation and/or services in connection with leisure activities (Dutch Civil Code, Article 6:230p e) apply.
This means that a reservation is binding. To accommodate you, Fontana has a cancellation policy for reservations, as described below and included in our Terms and Conditions. Depending on the type of reservation, it is often possible to cancel under certain conditions.

Cancellations by guest/general
- The guest is not entitled to cancel a reservation agreement, unless he/she irrevocably offers to pay the amounts set out below. Every cancellation shall be deemed to include such an offer. Such an offer is deemed to have been accepted if Fontana does not immediately reject the offer. Cancellation must be done by email or fax. The guest cannot derive any rights from a verbal cancellation or cancellation by letter as it cannot be determined when and at what time the guest informed Fontana of the cancellation or intention thereto. The provisions in Article 9 apply without prejudice to the provisions of other articles.
- Fontana may declare to the guest that it will regard certain individuals as a group no later than one month before the first catering service is to be provided according to the agreement. All provisions for groups shall then apply to such persons.
- In case of ‘no show’, the guest will be obliged to pay 100 percent of the reservation total at all times.
- If not all agreed on services are cancelled, the following provisions shall apply pro rata to the cancelled services.
- If one or more agreed on services are wholly or partially cancelled, the periods in the following articles will be increased by 4 months if the reservation total of the cancelled services exceeds the correspondingly calculated value of the other services that Fontana could have provided in the period in which the cancelled serviced should have been provided.
- In view of the cancelled catering agreement, the guest must fully reimburse Fontana for costs made and owed to third parties at the time of the cancellation, provided Fontana has not acted unreasonably by making these costs. The amounts in question shall be deducted from the reservation total referred to in the following provisions.

* Cancellation requests can only be submitted in writing via annuleren@fontanaresort.nl
**The arrival date can be moved free of charge up to three months past the original arrival date (once per reservation).

Cancellation by Fontana Resort Bad Nieuweschans
Fontana is fully entitled to cancel a catering agreement, unless the guest has given written notice within seven days of concluding the agreement that he/she wishes Fontana to waive its right to cancel, provided that the guest has also unequivocally stated that he/she waives their own right to cancel.

Complaints
We do our utmost best to provide you with high quality services. Unfortunately, it can happen that you are not satisfied, and we understand how upsetting this can be.
Do you have a complaint? Please let us know as soon as possible, as clearly and concisely as possible. You can use the contact form on our website or send an email to info@fontanaresort.nl.
Complaints will be answered within 14 days from the day of receipt. If a complaint requires a longer processing time, you will receive a message of receipt within 14 days stating when you can expect a more detailed response from us.

Fontana is not a member of any (extra-judicial) disputes committee.
